TERMS OF USE – HESTAURANT APP (CUSTOMER)

Welcome to Hestaurant.
These Terms of Use (“Terms”) govern access to and use of the Hestaurant application (“Application”, “Hestaurant” or “Platform”), developed and operated by Cavantech Corporation (“Cavantech”, “we”, “our” or “us”).
By creating an account, accessing or using Hestaurant or any of its features, the user (“User” or “Customer”) declares that they have read, understood and agree to these Terms.
If the User does not agree with any provision of these Terms, they must discontinue use of the Application.
1. ABOUT HESTAURANT
Hestaurant is a technology platform designed to connect customers and food service establishments, providing tools to facilitate interaction, placing and tracking orders, and other operations related to the customer experience at the establishment.
Among the features available, depending on the availability and configuration of each establishment, are:
- viewing digital menus;
- accessing menus via QR Code;
- identifying and accessing tables;
- placing orders;
- tracking order status;
- requesting assistance;
- communicating with the establishment through chat;
- digital payments;
- in-person payments using technologies such as Tap to Pay;
- using coupons and promotions;
- reviewing establishments;
- viewing order history;
- other features related to the dining experience.
Hestaurant primarily acts as a technology platform for intermediation and communication between customers and establishments.
Cavantech/Hestaurant does not prepare, supply, sell or deliver the food and products offered by restaurants, except when expressly indicated otherwise in a specific feature.
The commercial relationship concerning products and services purchased by the Customer occurs directly between the Customer and the establishment responsible for the order.
2. ACCEPTANCE OF THE TERMS
By creating an account or using Hestaurant, the User agrees to:
- comply with these Terms;
- comply with applicable laws;
- use the Platform ethically and appropriately;
- provide truthful and up-to-date information;
- respect the rights of other users and establishments.
If the User does not agree to these Terms, they must not use the Application.
3. REGISTRATION AND ACCOUNT
Certain features may require the creation of an account.
When registering, the User declares that they will:
- provide truthful, accurate and up-to-date information;
- keep their registration information up to date;
- use a valid telephone number when required for authentication;
- protect their credentials and access codes;
- not share their account in a manner that may compromise its security;
- be responsible for activities carried out through their account.
The following are prohibited:
- creating accounts using false information;
- creating accounts for the purpose of committing fraud;
- using another person’s identity without authorization;
- attempting to access another user’s account;
- using accounts in a manner that compromises the security of the Platform.
Hestaurant may request additional information or verification measures when necessary to protect accounts, prevent fraud or ensure Platform security.
4. USE OF THE PLATFORM
The User must use Hestaurant exclusively for lawful purposes and in accordance with these Terms.
The following are expressly prohibited:
- committing fraud or attempting to commit fraud;
- using false information;
- using the Application for unlawful activities;
- intentionally harming establishments or other users;
- using robots, bots, scripts or automated systems to access or exploit the Platform without authorization;
- attempting to access areas, accounts, data or systems that the User is not authorized to access;
- interfering with the normal operation of the Application;
- introducing malicious code or files;
- exploiting Platform vulnerabilities without authorization;
- sending spam or abusive content;
- using Hestaurant for purposes that may cause harm to Cavantech, establishments or third parties.
Violation of these rules may result in suspension or termination of the account, without prejudice to any other applicable measures.
5. ORDERS
Orders placed through Hestaurant are forwarded to the establishment selected by the Customer.
The restaurant is responsible for:
- accepting or rejecting orders;
- correctly informing available items;
- setting prices;
- providing information about ingredients and products;
- preparing orders;
- informing the estimated preparation time;
- making changes to or canceling orders;
- making advertised products available;
- complying with applicable regulations regarding food preparation and sale;
- resolving issues related to purchased products and services.
Submitting an order through the Application does not necessarily mean that the establishment has accepted it. Confirmation and processing depend on the establishment.
Hestaurant acts as a technological means of transmitting information between the Customer and the restaurant and does not control the establishment’s internal operations.
6. MENUS, PRODUCTS AND INFORMATION
The information displayed in menus is provided and managed by the respective establishments.
Restaurants are responsible for the accuracy of:
- product names;
- descriptions;
- ingredients;
- prices;
- promotions;
- availability;
- nutritional information, when provided;
- allergen information;
- other characteristics of the products.
Information may be changed by establishments at any time.
Hestaurant does not guarantee that all information provided by establishments will always be up to date or free from errors.
Customers with allergies, intolerances or other dietary restrictions should directly confirm the composition and safety of products with the establishment before consuming them.
7. PRICES AND PROMOTIONS
Prices for products and services are determined exclusively by the establishments.
The amounts displayed in the Application may be changed by restaurants, subject to the applicable conditions for orders already placed.
Promotions, discounts and special conditions may have specific rules, including:
- expiration date;
- limited quantity;
- minimum purchase amount;
- participating products;
- specific times;
- usage restrictions;
- participating establishments;
- other conditions determined by the establishment.
The application of a promotion will be subject to the conditions disclosed at the time of use.
8. PAYMENTS
When available, Hestaurant may offer different digital or in-person payment methods.
Payments may be processed by specialized companies and third parties responsible for financial processing, such as payment service providers.
Hestaurant may use integrations with payment providers to enable transaction authorization and processing.
Hestaurant does not store complete payment card information when processing is performed directly by specialized providers.
Authorization of a transaction depends on the respective payment provider, financial institution or payment method used.
The commercial relationship concerning the order remains between the Customer and the establishment responsible for it.
8.1. Refunds, Reversals and Disputes
Requests related to:
- refunds;
- charge reversals;
- payment cancellation;
- duplicate payments;
- discrepancies in amounts;
- unauthorized or incorrect charges;
- order-related issues;
- disputes concerning amounts charged for purchased products;
must initially be directed to the establishment responsible for the order, subject to applicable law and the rules of the respective payment method.
Hestaurant acts as a technology platform and does not have the authority, on its own, to authorize or determine refunds, reversals or cancellations of transactions carried out between the Customer and the establishment.
This does not affect any consumer rights provided by applicable law.
9. TAP TO PAY
Some establishments may offer in-person payments using Tap to Pay technology or equivalent technologies.
Under this method:
- payment is made in person between the Customer and the establishment;
- Hestaurant may act as a technological integration platform;
- transaction processing and authorization depend on the providers and financial institutions involved;
- availability of the feature may vary depending on the establishment, device, country, operating system and payment providers used.
Any issues related to authorization, charges, reversals or financial processing must be handled in accordance with the responsibilities of the establishment and the respective payment providers.
10. BASIC CUSTOMER INFORMATION AND SECURITY
For purposes of security, fraud prevention, user identification and protection against misuse of the Platform, certain establishments may be able to view basic information associated with the Customer’s account.
Such information may include, depending on the applicable feature and settings:
- profile picture;
- name;
- email address;
- telephone number.
Access to this information must occur in accordance with legitimate purposes related to the operation and security of the Platform and will be handled in accordance with Hestaurant’s Privacy Policy.
The establishment does not receive unrestricted access to the Customer’s data through this feature.
11. QR CODE AND TABLES
Hestaurant may use QR Codes to identify tables, establishments or other service areas.
The User agrees to:
- use only QR Codes legitimately provided by the establishment;
- not tamper with, modify or replace QR Codes;
- not attempt to access tables or areas that are not intended for their use;
- not use QR Codes to interfere with the service provided to other customers.
The establishment may close, change, deactivate or modify a table or service session at any time.
Hestaurant is not responsible for changes made directly by the establishment.
12. CHAT AND COMMUNICATION WITH THE ESTABLISHMENT
When available, Hestaurant may allow the Customer to send messages directly to the establishment.
The feature must be used exclusively for communication related to service and the experience at the establishment.
The following are prohibited in chat:
- harassment;
- threats;
- insults;
- spam;
- unauthorized advertising;
- illegal content;
- sending malicious files;
- attempted fraud;
- any purpose that violates these Terms.
Communications may be recorded, stored or analyzed when necessary for security, abuse prevention, problem resolution or compliance with legal obligations, as described in the Privacy Policy.
13. COUPONS AND PROMOTIONS
Hestaurant may provide coupons, discounts and other promotional benefits.
Each coupon may have specific conditions, such as:
- validity period;
- available quantity;
- minimum order amount;
- usage limit;
- participating products;
- participating establishment;
- user restrictions;
- other conditions presented at the time of the offer.
Coupons may not be used fraudulently or in violation of their conditions.
Improper use may result in cancellation of the benefit and, where applicable, suspension of the account.
14. REVIEWS AND USER-PUBLISHED CONTENT
When available, the User may review establishments and publish content related to their experience.
Reviews must represent genuine experiences and be presented respectfully.
The following may not be published:
- deliberately false information;
- offensive or abusive content;
- hate speech;
- discriminatory content;
- threats;
- third-party personal information without authorization;
- illegal content;
- spam or unauthorized advertising;
- content intended to artificially manipulate reviews or reputations.
Hestaurant may remove or restrict content that violates these Terms or applicable law.
Removal of content does not necessarily imply an obligation to proactively or continuously monitor all content posted by users.
15. RESPONSIBILITIES OF ESTABLISHMENTS
Establishments using Hestaurant are responsible for their own commercial operations.
This includes, among other things:
- menu information;
- prices;
- promotions;
- product availability;
- food preparation;
- product quality;
- customer service;
- compliance with applicable health and safety regulations;
- compliance with consumer protection laws;
- acceptance, modification or cancellation of orders;
- charging and processing of amounts related to orders, as applicable;
- reviewing refund or reversal requests related to products and services provided.
Hestaurant provides technological tools to facilitate these operations but does not control the internal activities of establishments.
16. SERVICE AVAILABILITY AND CONNECTIVITY
Cavantech seeks to keep Hestaurant available and functional but does not guarantee that the Platform will remain continuously available or error-free.
Interruptions or limitations may occur due to:
- maintenance;
- updates;
- technical failures;
- server unavailability;
- internet failures;
- issues with third-party services;
- device failures;
- infrastructure problems;
- attacks or security incidents;
- force majeure or unforeseen events.
The operation of certain features may also depend on the Customer’s or establishment’s internet connection.
17. INTELLECTUAL PROPERTY
Hestaurant, its visual identity, software, interfaces, features, code, trademarks, logos, texts, graphic elements, databases and other components of the Platform are protected by applicable intellectual property laws.
These elements belong to Cavantech Corporation or are used under authorization, license or other rights granted by their respective owners.
The User does not acquire any ownership rights over Hestaurant as a result of its use.
Without prior express authorization, it is prohibited to:
- copy;
- reproduce;
- modify;
- distribute;
- sell;
- sublicense;
- reverse engineer;
- attempt to extract source code;
- create derivative products;
- commercially exploit any part of the Platform.
18. PRIVACY AND DATA PROTECTION
The processing of personal data carried out in connection with Hestaurant is governed by the Platform’s Privacy Policy and applicable data protection laws.
Use of the Application may involve the processing of information necessary for:
- account creation and management;
- authentication;
- placing and tracking orders;
- payment processing;
- communication with establishments;
- fraud prevention;
- security;
- operation of features;
- user support;
- compliance with legal obligations;
- other purposes described in the Privacy Policy.
The User acknowledges that their data may be processed in accordance with the legal bases and purposes provided for under applicable law.
19. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Cavantech shall not be liable for acts or omissions that are the exclusive responsibility of establishments or third parties, including:
- food quality;
- product composition;
- allergies or reactions resulting from consumption;
- incorrect information provided by the restaurant;
- preparation delays;
- service delays;
- cancellations made by the establishment;
- product unavailability;
- failures in services provided by the establishment;
- damages arising from products or services supplied by the restaurant;
- incorrect information provided by the establishment;
- problems related to third-party services;
- payment provider failures;
- temporary unavailability of the Application caused by external factors;
- acts of third parties beyond Cavantech’s reasonable control.
With respect to payments and transactions carried out between the Customer and the establishment, matters such as refunds, reversals, incorrect charges, duplicate payments and discrepancies in amounts must be handled according to the responsibilities established in these Terms, without prejudice to rights guaranteed by applicable law.
Nothing in these Terms is intended to exclude or limit consumer rights that cannot legally be excluded or limited.
20. PLATFORM SECURITY
Cavantech adopts reasonable measures to protect the security and integrity of the Platform.
However, no system connected to the internet can be considered completely free of risks.
The User agrees not to attempt to:
- compromise the security of the Application;
- access unauthorized systems;
- obtain data belonging to other users;
- exploit vulnerabilities for improper purposes;
- interfere with the operation of the Platform.
Vulnerabilities or security issues identified by the User should be reported to Cavantech through the official Hestaurant channels available.
21. ACCOUNT SUSPENSION OR TERMINATION
Cavantech/Hestaurant may, within the limits of applicable law, suspend, restrict or terminate a User’s access when there are indications of:
- violation of these Terms;
- fraud or attempted fraud;
- abusive use of the Platform;
- security compromise;
- use of false information;
- unlawful activity;
- attempts to harm establishments, other users or the Platform itself;
- violation of third-party rights.
Where applicable, measures may be taken to protect users, establishments and system security.
Account termination or suspension does not eliminate obligations that, by their nature, should remain in effect after termination of use of the Platform.
22. CHANGES TO THESE TERMS
Cavantech may periodically update these Terms to reflect:
- changes to the Platform;
- new features;
- operational changes;
- legal or regulatory changes;
- security improvements;
- other needs related to the operation of Hestaurant.
The updated version will be made available through the Application or other appropriate channels.
When required by applicable law, significant changes may be accompanied by additional communication to the User.
Continued use of Hestaurant after the changes become effective may constitute acceptance of the updated Terms, where permitted by applicable law.
23. APPLICABLE LAW
These Terms shall be governed by and interpreted in accordance with the applicable laws of the Federative Republic of Brazil, without prejudice to consumer protection rules and other rights applicable to the User.
No provision of these Terms is intended to waive rights guaranteed to consumers by mandatory legal provisions.
Whenever permitted by applicable law, any disputes may be submitted to the competent court of the jurisdiction where Cavantech Corporation’s headquarters are located, subject to applicable jurisdictional and consumer protection rules.
24. GENERAL PROVISIONS
If any provision of these Terms is deemed invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect to the extent permitted by applicable law.
Any tolerance by Cavantech regarding a breach of any provision shall not constitute a waiver of its rights.
These Terms, together with the Privacy Policy and other documents expressly incorporated into the Platform, constitute the set of rules applicable to the Customer’s use of Hestaurant.

26. ACCEPTANCE STATEMENT
By creating an account, accessing or using Hestaurant, the User declares that they:
- have read these Terms of Use;
- have understood their content;
- agree to their provisions;
- undertake to use the Platform in accordance with these Terms and applicable law.
